Windy City Smokeout Plati-YUM Sweepstakes Official Rules

 

NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN THIS Sweepstakes. A PURCHASE DOES NOT IMPROVE CHANCES OF WINNING. Eligibility: Open to legal U.S. residents 18 years-of-age or older as of the date of entry (the “Entrant”). Void where prohibited or restricted by applicable law, and all applicable federal, state, and local laws and regulations apply.  Winners are responsible for any taxes, customs, duties, and like amounts connected with the prizes.  

How to play: Starting at 10:00 AM CT January 29, 2024 and ending at 11:59 PM CT February 11, 2024 (the “Sweepstakes Window”), download the Windy City Smokeout App and visit the Plati-Yum Sweepstakes section of the official Windy Smokeout app (App Store: https://apps.apple.com/us/app/windy-city-smokeout-2017/id1191366663?ls=1 or Google Play: https://play.google.com/store/apps/details?id=com.leye.wcsmokeout

 (“Promotion Sites”) and provide your email address and zip code to enter for a chance to win two Friday Platinum VIP tickets (alcohol portion excluded) to Windy City Smokeout on July 12, 2024 taking place at 1901 W Madison Street Chicago, IL 60612 with an approximate retail value of $1,876.39 ($800 per ticket, $259.14 in fees, $17.25 shipping) and one $250.00 Lettuce Entertain You gift card (with an approximate retail value of two hundred fifty dollars) redeemable at participating Lettuce Entertain You Restaurants. Entrants will be required to provide, among other information (see form for complete list), their email address, necessary to receive communication regarding promotion as well as for future promotional communications.  ENTRANTS MAY OPT OUT AT ANY TIME. One account per person/per entrant. Entries must contain all required fields to be eligible. One winner will be randomly selected from properly submitted entries.   Total approximate retail value of the prize is $2,126.39.

 

Regardless of the entry method, there is a limit of one (1) entry per Entrant for the entire Sweepstakes Window. Any attempt by an Entrant to obtain more than the stated number of entries by using multiple/different identities, and/or any other methods will void that Entrant’s entry and that Entrant may be disqualified from the Sweepstakes. Entries submitted by anyone other than the Entrant are void. In case of dispute as to the identity of any Entrant, entry will be declared made by the registered name and address on such entry. Any potential prize winner may be requested to provide Sponsor with proof that such person is the prize winner.

 

How to claim your prize: The Winner will be notified by email at or about 10:00 AM  CT February 12, 2024.  Gift Card and Tickets will be mailed to the address provided by winner (gift card no later than February 28, 2024, wristbands for Windy City Smokeout prior to July 10, 2024). The winner will be required to provide their full name, email and mailing address and respond within 48 hours to remain eligible.  Failure to respond within the applicable time period will result in forfeiture of the prize and Sponsor will have the option and not the obligation to award the prize to an alternate winner. Sponsor shall require the prize winner to execute an affidavit of eligibility, publicity release (except where prohibited), liability waiver and/or IRS Form W-9 prior to the delivery of any prize (collectively, “Affidavit“).  Should winner use less than the full prize, the value of the prize for tax purposes will not be reduced. If the prize winner does not respond to the notification within 48 hours, is found to be ineligible, fails to provide adequate information, or fails to execute the Affidavit or other documentation required by Sponsor and/or the prize notification is returned as undeliverable, the Sponsor may consider such prize winner to have forfeited the prize, and another prize winner may be selected in the sole discretion of Sponsor. Sponsor is not responsible for lost, late, misdirected, incomplete or incorrect entries or notices even if caused by human error on the part of Sponsor.   

  

General Provisions: No prize substitutions allowed and no cash alternatives or refunds are available. Prizes are non-transferable. No Prize includes alcoholic beverages.  Prize does not include travel, transportation, or accommodations of any kind. Except where prohibited by law, participation in this promotion and/or acceptance of any prize constitutes permission to use winner’s name, hometown, likeness and photograph for advertising and publicity purposes without additional compensation.

 

All Employees of Lettuce Entertain You Enterprises, Inc., Clark Hubbard LLC (“Sponsor”), their respective agencies, affiliates, subsidiaries, advertising and promotion agencies, and members of the immediate families and household members of each are not eligible. Odds of winning prize depend on the number of eligible entries received.

 

This promotion is no way sponsored, endorsed, or administered by, or associated with Google, Apple, Facebook or Instagram. Your entry to this contest constitutes a full and complete release of Google, Apple, Facebook and Instagram from any and all liability related to this promotion. You are providing your information to Sponsor, and not to Google, Apple, Facebook or Instagram. 

 

By participating, Entrants agree to abide by and be bound by these official rules and all Sponsor decisions. By participating and/or accepting the prize, Entrants/winners agree to release Sponsor and Lettuce Entertain You Enterprises, Inc., and its respective affiliates, subsidiaries, directors, officers, employees, and agents as stated herein from any and all liability for any injuries, losses or damages of any kind caused by any prize or resulting from acceptance, possession, use, and/or misuse of any prize or participation in this promotion or in prize-related activities and that Sponsor may use Entrant’s name, likeness and submitted photograph (if applicable) for advertising and publicity purposes, in any and all media now or hereafter known, without further notice or compensation (except where prohibited by law). Winners acknowledge that neither Sponsor nor its agents have made, nor are in any manner responsible or liable for, any warranty, representation, or guarantee, express or implied, in fact or in law, relative to any prize.

 

Any and all disputes, claims, and causes of action arising out of or in connection with this Promotion shall be resolved individually, without resort to any form of class action.  This Promotion shall be governed by, and construed in accordance with, the laws of the State of Illinois, regardless of conflicts of laws principles. Any action or litigation concerning this Promotion shall take place exclusively in the federal or state courts sitting in Cook County, Illinois, and each Entrant expressly consents to the jurisdiction of and venue in such courts and waives all defenses of lack of jurisdiction and inconvenient forum with respect to such courts.  Each Entrant agrees to service of process by mail or other method acceptable under the laws of the State of Illinois. ANY CLAIMS, JUDGMENTS AND/OR AWARDS SHALL BE LIMITED TO ACTUAL OUT-OF-POCKET COSTS ASSOCIATED WITH ENTERING THIS PROMOTION.  REGISTERED PARTICIPANT HEREBY WAIVES ANY RIGHTS OR CLAIMS TO ATTORNEY’S FEES, INDIRECT, SPECIAL, PUNITIVE, INCIDENTAL OR CONSEQUENTIAL DAMAGES OF ENTRANT, WHETHER FORESEEABLE OR NOT AND WHETHER BASED ON NEGLIGENCE OR OTHERWISE.
